I can see exactly what you mean about this. Harry and Hermione were technically not in any relationships at the time this happened, for the purpose of this, anyway. It's like Emma Watson described about the dance shared between Harry and Hermione in the film, "there's always that awkward stage in a friendship when you wonder whether it could be more," They didn't go into it thinking they'd end up having sex, but they did succeed in making each other feel a bit better, seizing the moment, so to speak
